Islamic Marriage Conditions Agreement
Important: This document is intended to record agreed conditions between prospective spouses before entering into a Muslim marriage (Nikah). It should be considered together with the Nikah contract and, where appropriate, supplemented by independent legal advice and guidance from a qualified Islamic scholar.

1. PURPOSE
The parties intend to enter into a valid Islamic marriage (Nikah) and wish to record certain mutual rights, responsibilities and conditions agreed upon prior to the solemnisation of their marriage.
The parties acknowledge that marriage in Islam is founded upon mutual respect, kindness, dignity, compassion and cooperation.
2. MAHR (DOWER)

3. FINANCIAL RESPONSIBILITIES
The Husband acknowledges his Islamic obligation to provide maintenance (Nafaqah), including reasonable accommodation, food, clothing and essential living expenses according to his means.
The parties further agree as follows:

☐ The Wife shall not be required to contribute financially unless she voluntarily chooses to do so.

The parties support one another’s educational and personal development aspirations.

6. RESIDENCE
The parties intend to reside at:
Any permanent relocation to another city, province or country shall be discussed and agreed upon jointly, taking into account family circumstances, employment and educational opportunities.
7. FAMILY RELATIONSHIPS
The parties agree to treat each other’s family members with dignity, courtesy and respect.
The parties acknowledge the importance of maintaining healthy family ties consistent with Islamic principles and reasonable marital boundaries.

8. CHILDREN
Should Allah bless the marriage with children, the parties agree to:
- Raise the children within the Islamic faith;
- Act in the children’s best interests;
- Make educational decisions jointly;
- Promote a loving and nurturing home environment.

9. DISPUTE RESOLUTION
Should a dispute arise, the parties agree to make sincere efforts toward reconciliation.
The following process will be followed before considering separation:
Step 1
Direct discussion between the spouses.
Step 2
Mediation involving mutually agreed family members.
Step 3
Consultation with an agreed Islamic scholar, Imam or mediation body.
Step 4
Professional mediation where appropriate.
10. POLYGAMY (OPTIONAL CLAUSE)
This clause should only be included where both parties expressly wish to do so.
The parties agree that:
☐ No further marriage shall be contracted by the Husband during the subsistence of this marriage without the prior written consent of the Wife.

11. SOCIAL MEDIA AND PRIVACY
The parties agree to:
- Respect each other’s privacy;
- Not disclose private marital matters publicly;
- Avoid conduct that may unnecessarily damage the dignity or reputation of the other spouse.

12. DOMESTIC VIOLENCE AND ABUSE
The parties acknowledge that Islam prohibits oppression, abuse and unjust conduct.
The parties agree that there shall be no:
- Physical abuse;
- Emotional abuse;
- Verbal abuse;
- Financial abuse;
- Coercive or controlling behaviour.
Any concerns regarding abuse shall be addressed immediately through appropriate legal, religious and professional channels.
13. DISSOLUTION OF THE MARRIAGE
Should the marriage unfortunately break down, the parties agree to seek dissolution in a manner consistent with:
- Islamic principles;
- Fairness and dignity;
- The welfare of any children;
- Applicable South African law.
The parties acknowledge the recognised Islamic mechanisms of divorce, including Talaq, Khula, Faskh and Mubarat where applicable.
14. ADDITIONAL SPECIAL CONDITIONS
The parties agree to the following additional conditions:
